How long is a party wall notice valid?

Why you should avoid serving notices too early in a building programme.

Under the Party Wall etc. Act, a notice for works to an existing party structure can cease to have effect if the work has not begun within 12 months of service. The Act has corresponding timing provisions for other notice types. A notice is not intended to authorise an indefinite project years later.

Notice periods and validity are different

The notice period is the minimum time before work starts—ordinarily two months for section 3 and one month for section 1 or section 6. The validity period concerns how long the notice remains effective after service. Both must be considered.

What if the building timetable changes?

If the work starts later than expected, check whether the notice remains effective and whether the description still accurately covers the revised proposal. Substantial changes to the work may need fresh notice or further agreement.

What if the notice was served on a different day?

The date in your generated PDF is an intended service date. If you actually serve it later, the starting-date calculation can change. Confirm the dates and generate an updated document if needed before giving it to your neighbour.

Can work start earlier?

In appropriate cases the adjoining owner may agree in writing to earlier work, but this site's automated builder does not handle early-start arrangements. See the official booklet for the relevant provisions.
